I. Scope of application

1. This technical regulation is developed in accordance with the Treaty in the Eurasian Economic Union dated May 29, 2014 to ensure protection of human life and health, of the environment, and to prevent activities misleading consumers (users) of electrical and radio-electronic products in respect to contents of hazardous substances in them.

This technical regulation establishes mandatory requirements for use and application within the Eurasian Economic Union (hereinafter — the Union) in respect to restriction of use of hazardous substances in electrical and radio-electronic products released into circulation within the Union to ensure their unrestricted movement.

If any technical regulations of the Union (Customs Union) in respect to electrical and radio-electronic products that set requirements to such products are adopted, such electrical and radio-electronic products should comply with requirements of all technical regulations of the Union (Customs Union) applicable to them.


2. This technical regulation applies to electrical and radio-electronic products released into circulation in the Union according to the list provided in annex N 1.


3. This technical regulation does not apply to:

a) electrical and radio-electronic products intended for use at nominal voltage over 1000V AC and 1500V DC, if not otherwise prescribed by annex N 1 to this technical regulation;
b) electrical and radio-electronic products intended solely for use as components of electrical equipment not included to the list provided in annex N 1 to this technical regulation;
c) electric toys;
d) photovoltaic panels (solar cells) used as components of electrical and radio-electronic equipment;
e) electrical and radio-electronic products intended for use in ground and orbital space objects;
f) electrical equipment intended solely for use in air, water, road and underground transport;
g) electric batteries and accumulators, including those released into circulation in the Union as components of electrical and radio-electronic products;
h) pre-owned (used) electrical and radio-electronic products;
i) measuring instruments;
j) medical products.


II. General definitions

4. The following terms and their definitions are used for the purposes of application of this technical regulation:

"toy" — a product or material intended for playing of a child (children) under 14 years;

"electric toy" — a toy with at least one function preformed through electric power;

"electrical and radio-technical products" — products whose functioning for their intended purpose is preconditioned by presence, use, generation, transformation, transmission and distribution of electric currents and/or electromagnetic fields, which are intended for immediate use or built-into machines, mechanisms, appliances, devices and other equipment;

"importer" — a resident of a Member-State of the Union who entered into a foreign trade agreement with a non-resident of a Member-State of the Union for the transfer of electrical and radio-electronic products, who sells these facilities and is responsible for their compliance with the electromagnetic compatibility requirements of this technical regulation;

"not varying (homogeneous) material" — a material with constant composition through its all volume, consisting of one substance or a combination of substances and/or materials that cannot be separated by mechanical methods (by dismantling, cutting, blending, grinding or any other mechanical action).


III. Rules of circulation of electrical and radio-electronic products in the Union market

5. An electrical or radio-electronic product is released into circulation in the Union provided that it conforms to this technical regulation, and other technical regulations of the Union (Customs Union) applicable to it, and provided that it underwent the procedure of confirmation of conformity according to section VII of this technical regulation, as well as other applicable technical regulations of the Union (Customs Union.


6. An electrical or radio-electronic product which does not prove compliance with requirements of this technical regulation, or requirements of other technical regulations of the Union (Customs Union), may not be labeled with the Common mark of product circulation in the market of the Union.


IV. Requirements to restriction of use of hazardous substances

7. Electrical or radio-electronic equipment should be designed and manufactured in such way, that it does not contain:

a) hazardous substances according to the list provided in annex N 2;
b) not varying (homogeneous) materials containing hazardous substances in concentrations exceeding the permissible level provided in the list according to annex N 2 to this technical regulation.


8. Electrical and radio-electronic products are subject to special requirements to restriction of use of hazardous substances according to [[#Annex N 3 to the Technical Regulation of the Eurasian Economic Union "On Restriction of Use of Hazardous Substances in Electrical and Radio-Electronic Products (TR EAEU 037/2016)|annex N 3}.


V. Requirements to labelling and exploitation documents

9. Electrical and radio-electronic product should be labelled with its name and/or designation (type, brand, model, if any), its basic parameters and characteristics, name and/or trademark of the manufacturer, country where this electrical and radio-electronic product was manufactured; this information should also be provided in attached exploitation documents.

The package should be also labelled with the name of the manufacturer and/or manufacturer’s trademark, the name and designation of the equipment (type, brand, model, if any).


10. If it is impossible to label an electrical and radio-electronic product with information specified in paragraph 9 of this technical regulation, it may be provided only in exploitation documents attached to the equipment. In this case the package should be labelled with the name and designation of the electrical and radio-electronic product (type, brand, model, if any), the name of the manufacturer and/or manufacturer’s trademark.


11. Label of the electrical and radio-electronic product should be legible, easy-to-interpret and should be placed on the electrical and radio-electronic product in a place accessible without disassembling.


12. Exploitation documents for the electrical and radio-electronic product should contain:

a) information specified in paragraph 9 of this technical regulation;
b) information on intended use of the product;
c) product characteristics and parameters;
d) rules and conditions of exploitation (use), installation, storage, carriage (transportation), sale and disposal (if necessary — the appropriate requirements);
e) information on actions that should be taken in case of malfunction of the product;
f) name and location of the manufacturer (person authorized by the manufacturer), importer, their contacts;
g) information on month and year when the product was manufactured and/or place where such information is located, or the method to determine the year of manufacture.


13. Labels and exploitation documents should be in Russian and, if prescribed by the appropriate requirements of laws of Member-States of the Union (hereinafter — the Member-States), In the official language (official languages) of the Member-State in which products are sold. Units, letter-marks, proper names, names of localities and other names and information in labels and exploitation documents may be provided in other languages.

Exploitation documents should be provided in hard copy. Copy of exploitation documents may be attached to them on electronic media. It is possible to provide exploitation documents for non-domestic electrical and radio-electronic products only on an electronic medium.


VI. Compliance of electrical and radio-electronic products with requirements of this technical regulation

14. Compliance of an electrical and radio-electronic product with this technical regulation is assured by meeting its requirements to restriction of use of hazardous substances.


15. Methods of research (tests) and measurements of electrical and radio-electronic products are set by the standards included in the list of standards containing rules and methods of research (tests) and measurements, including rules of taking samples needed for implementation and fulfilment of requirements of this technical regulation and evaluation of compliance of products.


VII. Evaluation of compliance of electrical and radio-electric products

16. Evaluation of compliance of electrical and radio-electronic products is arranged through confirmation of conformity.


17. In the course of confirmation of conformity of electrical and radio-electronic products in a Member-State applicants may register according to its laws a legal person or an individual acting as a private entrepreneur as a manufacturer (seller) or persons authorized by the manufacturer.


18. Electrical and radio-electronic products should undergo the procedure of confirmation of conformity according to one of the following schemes:

a) for mass production items — schemes 1d, 3d and 6d;
b) for a batch of products — schemes 2d and 4d


19. For the purposes of declaration of conformity of electrical and radio-electronic products applications may be submitted by:

a) for schemes 1d, 3d and 6d — the manufacturer (person authorized by the manufacturer);
b) for schemes 2d and 4d — the manufacturer (person authorized by the manufacturer) or the importer (seller).


20. Scheme for declaration of conformity of electrical and radio-electronic product is selected by the applicant.


21. Declaration of conformity of electrical and radio-electronic products on schemes 1d and 2d is made by the applicant with its own evidences. Tests of sample electrical and radio-electronic products are performed at the discretion of the applicant either in the applicant’s testing laboratory, or in an accredited testing laboratory (center) included to the Common Register of certification bodies and testing laboratories (centers) of the Customs Union (hereinafter — the Common Register), or in other testing laboratory.

Declaration of conformity of electrical and radio-electronic products on schemes 3d, 4d and 6d is made by the applicant with its own evidences and evidences obtained with participation of an accredited testing laboratory (center) included to the Common Register.


22. During the procedure of declaration of conformity of electrical and radio-electric products the applicant:

a) prepares and analyses documents that prove conformity of products to requirements of this technical regulation, including:
  • technical specifications (if any);
  • operational documents;
  • a test report (reports) for samples of products and/or constituent parts, materials, components of products for compliance with requirements of this technical regulation and/or other documents at the discretion of the applicant that served the basis to confirm conformity of products with requirements of this technical regulation (if any) (schemes 1d, 2d, 3d, 4d and 6d);
  • supply contract (contract) and shipping documents (if any) (for a batch of products, a single product) (schemes 2d and 4d);
  • quality management certificate (copy of the certificate) (scheme 6d);
b) identifies products in order to submit them to the scope of this technical regulation;
c) ensures performance of in-process control and takes all necessary steps to arrange that the product manufacturing process resulted in their conformity with requirements of this technical regulation;
d) takes all necessary steps to ensure stable operation of the quality management system (scheme 6d);
e) adopts the declaration of conformity executed in the unified form and according to rules approved by the Decision of the Board of the Eurasian Economic Commission dated December 25, 2012 N 293;
f) applies the Common mark of product circulation in the market of the Union upon completion of the procedure of confirmation of conformity;
g) upon completion of the procedure of confirmation of conformity prepares a package of documents that includes documents provided in subparagraph "a" of this paragraph, and the declaration of conformity.


23. Declaration of conformity should be registered according to the procedure prescribed by the Decision of the Board of the Eurasian Economic Commission dated April 9, 2013 N 76.


24. Declaration of conformity of mass produced electrical and radio-electronic products is valid for no longer than 5 years. Term of validity of a declaration of conformity of a batch of electrical and radio-electronic products is unspecified.


25. At the discretion of the applicant, confirmation of conformity of electrical and radio-electronic products in the form of declaration of conformity may be replaced with confirmation of conformity in the form of certification according to one of the following schemes:

a) for mass production items — schemes 1c, 2c and 6c;
b) for a batch of products — scheme 3c.


26. For certification of electrical and radio-electronic products applications may be submitted by:

a) for schemes 1c, 2c and 6c — the manufacturer (person authorized by the manufacturer);
b) for the scheme 3c — the manufacturer (person authorized by the manufacturer) or importer (seller).


27. Scheme for certification of electrical and radio-electronic products is selected by the applicant.


28. During certification of conformity of electrical and radio-electric products the applicant:

a) takes all necessary steps to arrange for a stable process of manufacture of products, and ensure their conformity to requirements of this technical regulation;
b) prepares the following technical documents:
  • technical specifications (if any);
  • operational documents;
  • supply contract (contract) and shipping documents (if any) (for a batch of products) (scheme 3c);
  • quality management certificate (copy of the certificate) (scheme 2c);
  • other documents at the discretion of the applicant that served the basis to confirm conformity of products with requirements of this technical regulation (if any);
c) submits the application for certification of products (with appended technical document) to the certification authority included to the Unified Register. The application should contain information about the document for compliance of which its quality management system has been certified (scheme 2c), and about identifiable characteristics of a batch of products and product units included into it (scheme 3c);
d) applies the Common mark of product circulation in the market of the Union upon completion of the procedure of confirmation of conformity;
e) in case of any changes in design or process technology that may affect conformity of products to requirements of this technical regulation, advises the certification authority about them in advance (scheme 1c);
f) upon completion of the procedure of confirmation of conformity prepares a package of documents that includes documents provided in subparagraph "b" of this paragraph, test report (reports), results of production status analysis (scheme 1c) and the certificate of conformity.


29. During certification of electrical and radio-electronic products the certification authority included to the Unified register:

a) analyzes technical documents submitted by the applicant and advises the applicant of its decision (stating conditions of performance of certification);
b) identifies samples of products and takes them from the applicant to perform tests;
c) arranges for testing of samples of products (a batch of products (batch sample) (scheme 3c)) in an accredited testing laboratory (center) included to the Unified Register;
d) performs production status analysis on manufacture of the applicant with drawing a statement on results (scheme 1c);
e) in case of positive results of tests and production status analysis, executes a certificate of conformity in the unified form approved by Decision of the Board of the Eurasian Economic Commission dated December 25, 2012 N 293, and issues it to the applicant;
f) records information on the certificate of conformity to the unified register of certificates of conformity and registered declarations of conformity;
g) performs inspection control in respect to certified products during the whole term of validity of a certificate of conformity through testing of samples in an accredited testing laboratory (center) included to the Unified Register and/or through production status analysis (scheme 1c);
h) performs inspection control in respect to certified products during the whole term of validity of a certificate of conformity through testing of samples in an accredited testing laboratory (center) included to the Unified Register and analysis of results of inspection control by the authority certifying quality management system in respect to the certified quality management system (scheme 2c);
i) if results of inspection control are positive, confirms validity of the certificate of conformity and make the appropriate record to the statement of inspection control; if results of inspection control are negative, resolves to suspend or cancel the certificate of conformity and advises the information about such decision to the applicant (schemes 1c and 2c).


30. In case of confirmation of conformity (declaration of conformity or certification) on schemes that anticipate certification of quality management system, procedures of certification of such system will be performed by the quality management system certifying authority in the Member-State according to laws of such state and accredited in the national accreditation system of the Member-State.


31. Certificate of conformity for mass produced electrical and radio-electronic products is valid no longer than 5 years. Term of validity of a certificate of conformity of a batch of electrical and radio-electronic products is unspecified.


32. Set of documents created after confirmation of conformity of electrical and radio-electronic products is stored:

a) for items of mass production — by the applicant at least 10 years from the date of expiration of the declaration of conformity or certificate of conformity;
b) for a batch of products — by the applicant at least 10 years from the date of end of selling the batch of products;
c) for a product — by the manufacturer (person authorized by the manufacturer) at least 10 years from the date of discontinuation of production (end of production) of such product.


VIII. Labeling by the common mark of product circulation in the Union market

33. Electrical and radio-electronic product conforming to requirements of this technical regulation and having undergone the procedure of conformity confirmation in accordance with section VII of this technical regulation should be labelled by the common mark of products circulation in the Union market.


34. Products should be labelled by the Common mark of products circulation in the Union market before release of an electrical and radio-electronic into circulation in the Union market.


35. Each electrical and radio-electronic product should be labelled by the common mark of products circulation in the Union market in a way that will be clear and legible during the whole exploitation period of technical equipment, the common mark should also be provided in attached exploitation documents.

If it is impossible to label an electrical and radio-electric product itself with the common mark of products circulation in the Union market, the common mark should be provided on the product package and the attached exploitation documents.


36. Electrical and radio-electronic product should be labelled by the common mark of products circulation in the Union market, if it conforms to requirements of all technical regulations of Union (Customs Union) applicable to it.


Annex N 1 to the Technical Regulation of the Eurasian Economic Union "On Restriction of Use of Hazardous Substances in Electrical and Radio-Electronic Products (TR EAEU 037/2016)

List of electrical and radio-electronic products that are subject to the technical regulation of Eurasian Economic Union "On Restriction of use of hazardous substances in electrical and radio-electronic products" (TR EAEU 037/2016)

1. Household electric apparatus and appliances:

a) for cooking and storage of food and mechanization of cooking operations, and other kitchen appliances;
b) for treatment (washing, ironing, drying, cleaning) of underlining, clothes and shoes;
c) for dirt removal and cleaning of premises;
d) for maintenance and regulation of microclimate in premises;
e) sanitary and hygienic;
f) for hair, nail and skin care;
g) for warming of body;
e) for vibratory massage;
h) gaming, sporting and training equipment;
i) audio and video equipment, TV and radio broadcast receivers;
j) sewing and knitting;
k) power units, charging units, constant voltage units;
l) for fruit and vegetable gardening;
m) for aquaria and garden ponds;
n) electric pumps;
o) electric and electronic clocks;
p) calculators;
q) wiring devices;
r) extension cables.


2. Electronic data processing machines and devices connected to them, including combinations thereof:

a) servers, system units of personal computers;
b) laptop computers;
c) tablet, pocket, handheld and other small-size computers;
d) keyboards, manipulators, trackers and other control and input devices (computer mice, joysticks, helmets, glasses);
e) removable storage drives;
f) monitors;
g) printers;
h) scanners;
i) speaker systems and earphones;
j) multimedia projectors;
k) biometric readers;
l) web cameras;
m) modems;
n) uninterruptible power supply units.


3. Telecommunication facilities (terminal telecommunication devices):

a) fixed-line and mobile telephones;
b) coin-box telephones;
c) telefaxes;
d) telexes;
e) hand-held and portable radio stations;
f) radio frequency identification tags.


4. Copier machines and other electric office (clerical) equipment.


5. Electric tools (hand-held and portable electric machines).


6. Light sources and lighting equipment, including equipment built into furniture.


7. Electric musical instruments.


8. Gaming and vending machines.


9. Cash registers, ticket printing machines, ID card readers, automated teller machines, self-service terminals.


10. Cables, wires and cords designed for use at nominal voltage not exceeding 500V AC and/ir DC, except fiber optic cables.


11. Circuit breakers and protection tripping devices.


12. Fire-alarm, security alarm, security and fire alarm systems.

* Date of validity means that upon reaching the indicated date release of electrical and radio-electronic products into circulation will be possible only subject to observance of requirements to contents of hazardous substances provided in paragraph 7 of the technical regulation.
