Technical Regulation of the Customs Union 020/2011 "Electromagnetic compatibility of technical equipment"

Introduction

1. This technical regulation of the Customs Union is developed in accordance with the Agreement on Common principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation dated 18 November 2010.

2. This technical regulation of the Customs Union is developed to ensure the establishment of unified mandatory requirements on electromagnetic compatibility of technical equipment within the common customs territory of the Customs Union and to ensure free movement of technical equipment released into circulation within the common customs territory of the Customs Union.

3. If any other technical regulations of the Customs Union that set requirements on technical equipment are adopted, such equipment should comply with the applicable requirements of those technical regulations.

Article 1. Scope of application

1. This technical regulation of the Customs Union applies to the technical equipment released into circulation within the common customs territory of the Customs Union and can cause electromagnetic interference and (or) the operational quality of which depends on external electromagnetic interference.

2. This technical regulation of the Customs Union does not apply to the equipment:

  • which is used as an internal part of other equipment by its manufacturer and is not designed for autonomous use;
  • which is passive with regard to electromagnetic compatibility;
  • which is not included in the Common list of products that are subject to mandatory requirements in the Customs Union adopted by the Commission of the Customs Union (hereinafter, the Commission).

If technical regulations of the Customs Union that set (fully or partially) more specific requirements for electromagnetic compatibility for certain classes, groups and types of products are adopted then this technical regulation of the Customs Union shall become invalid with regard to this technical equipment and requirements for electromagnetic compatibility since the effective date of the technical regulations in question.

3. This technical regulation of the Customs Union sets the requirements for electromagnetic compatibility of technical equipment in order to ensure protection of human life and health, property, as well as to prevent misleading of the consumers of technical equipment.

4. This technical regulation of the Customs Union does not govern matters related to the radio frequency spectrum, which are regulated by the national laws on communications of the Member States of the Customs Union.

Article 2. Definitions

The following terms and their definitions are used in this technical regulation of the Customs Union:

  • apparatus - structurally completed technical means with a body (hull) and, if necessary, having the devices (ports) for external connections, designed for the consumer (user) use;
  • manufacturer – a legal entity or a person who produces and sells technical equipment on their behalf and is responsible for its compliance with the electromagnetic compatibility requirements of the technical regulation of the Customs Union;
  • importer – a resident of a Member-State of the Customs Union who entered into a trade agreement with a non-resident of a Member-State of the Customs Union for the transfer of technical equipment, who sells these facilities and is responsible for their compliance with the electromagnetic compatibility requirements of the technical regulations of the Customs Union;
  • component – a structurally complete part of technical equipment designed to be integrated into the apparatus by consumer (user);
  • market circulation of technical equipment – post-manufacturing processes of technical equipment transition from manufacturer to consumer (user) within the common customs territory of the Customs Union;
  • intended use – the use of technical equipment in accordance with the purpose specified on this technical equipment and (or) in operational documents by the manufacturer;
  • technical equipment – any electrical, electronic or radio-electronic product, as well as any product containing electrical and (or) electronic components that may be categorized as: a component unit, an apparatus and an installation;
  • technical equipment, passive with regard to electromagnetic compatibility – technical equipment that by virtue of its design and functionality, if used without additional protections against electromagnetic interference, such as screening or filtering, is unable to create electromagnetic interference that disturb the operation of communications devices and other technical equipment as intended, and is able to operate without degradation when exposed to electromagnetic interference, provided that electromagnetic environment conforms to this technical equipment operational documents (types of technical equipment, passive with regard to electromagnetic compatibility, are listed in annex 11 to this technical regulation of the Customs union);
  • a person authorized by the manufacturer – an entity or a natural person duly registered by a Member-State of the Customs Union that is assigned by the manufacturer by virtue of the mutual agreement for confirmation of conformity and sale of goods on behalf of the manufacturer within the common customs territory of the Customs Union, as well as for taking liability for non-conformity of goods to the requirements of the technical regulation of the Customs Union;
  • installation (mobile or fixed) – a set of interconnected devices and, if necessary, other hardware intended for use by the consumer (user) as a product with a single functional purpose and having a single technical documentation;
  • tolerance to electromagnetic interference (immunity) – the ability of technical equipment to preserve its operational quality when exposed to electromagnetic interference with regulated parameter values;
  • electromagnetic compatibility – the ability of technical equipment to operate with given quality in a given electromagnetic environment and not to cause harmful electromagnetic interference with other technical equipment;
  • electromagnetic environment – the set of electromagnetic phenomena and processes in a given region of space;
  • electromagnetic interference – an electromagnetic phenomenon or a process that reduces or may reduce the operational quality of technical equipment.

Article 3. Rules of market circulation

1. Technical equipment is released into circulation provided that it conforms to this technical regulation of the Customs Union as well as other technical regulations of the Customs Union applicable to it, and provided that it underwent the procedure of confirmation of conformity according to article 7 of this technical regulation of the Customs Union as well as other applicable technical regulations of the Customs Union.

2. Technical equipment, which does not prove compliance with requirements of this technical regulation of the Customs Union, may not be labeled with the Common mark of product circulation in the market of the Member States of the Customs Union and may not be released into circulation.

3. Equipment not labeled with the Common mark of product circulation in the market of the Member States of the Customs Union may not be released into circulation.

Article 4. Electromagnetic compatibility requirements

Technical equipment should be designed and manufactured so that while using it in accordance with its intended use and its installation, exploitation (use), storage, transportation and technical service requirements the following conditions were observed:

  • electromagnetic interference produced by the technical equipment should not exceed the level required for communication and other types of technical devices to work as intended;
  • technical equipment should have degree of tolerance to electromagnetic interference that ensures its operation in electromagnetic environment it is designed to work in.

Types of electromagnetic interference may be produced by the technical device and (or) may affect its work are listed in annex 2 to this technical regulation of the Customs union.

Article 5. Labelling and exploitation documents requirements

1. Technical equipment should be labelled with its name and (or) designation (type, brand, model, if any), its basic parameters and characteristics, name and (or) trademark of the manufacturer, country where this equipment was manufactured; this information should also be provided in attached exploitation documents.

The package should be also labelled with the name of the manufacturer and (or) manufacturer’s trademark, the name and designation of the equipment (type, brand, model, if any).

2. If it is impossible to label the technical equipment with the information specified in paragraph 1 of this article it may be provided only in exploitation documents attached to the equipment. In this case the package should be labelled with the name of the manufacturer and (or) manufacturer’s trademark, the name and designation of the equipment (type, brand, model, if any).

3. Label of the technical equipment should be legible and visible without disassembling.

4. Exploitation documents for the technical equipment should contain:

  • information specified in paragraph 1 of this article;
  • information on the technical equipment intended use;
  • characteristics and parameters;
  • rules and conditions for the technical equipment installation, for its connection to the electric power supply and other technical devices, for its turning on, tuning and exploitation, if implementation of these rules and conditions is necessary to assure the compliance of the technical equipment with the requirements of this technical regulation of the Customs Union;
  • information on exploitation restrictions of this technical equipment considering its intended use in residential, commercial and manufacturing areas;
  • rules and conditions of safe exploitation (use);
  • rules and conditions of storage, transportation, sale and utilization (if necessary –establishment of requirements for these procedures);
  • information on measures that should be taken if malfunction is revealed;
  • name and location of the manufacturer (person authorized by the manufacturer), the importer, their contacts;
  • month and year when the technical equipment was manufactured and (or) information locating and determining year of manufacturing.

5. Exploitation documents should be provided in Russian language and the official language (or languages) of the member state of the Customs Union if it is required by the Customs Union member state law.

Exploitation documents should be provided in hard copy. Electronic copy of exploitation documents may be attached to them. It is possible to provide exploitation documents for non-domestic technical equipment only on an electronic medium.

Article 6. Compliance of technical equipment with electromagnetic compatibility requirements

1. Compliance of the technical equipment with this technical regulation of the Customs union is assured by meeting its electromagnetic compatibility requirements directly or conformity to the standards included in the List of standards, voluntary implementation of which assures compliance with the requirements of the technical regulation of the Customs union.

2. Methods of research (tests) and measurements of technical equipment are set by the standards included in the List of standards containing rules and methods of research (tests) and measurements including rules of choice of samples needed for implementation and fulfilment of requirements of the technical regulation of the Customs union and evaluation (confirmation) of products’ compliance with it.

Article 7. Confirmation of conformity

1. Technical equipment should undergo the procedure of confirmation of conformity to the requirements for electromagnetic compatibility of this technical regulation of the Customs Union before it is released into circulation.

Technical equipment undergoes the procedure of confirmation of conformity according to the schemes set out in this technical regulation of the Customs Union, in accordance with the Provision on the procedure of use of standard evaluation (confirmation) schemes in the technical regulations of the Customs Union, approved by the Commission.

2. Technical means listed in Annex 3 to this technical regulation of the Customs Union should undergo the procedure of confirmation of conformity in the form of certification (schemes 1c, 3c, 4c).

Technical means not included in the List, should undergo the procedure of confirmation of conformity in the form of declaration of conformity (schemes 1d, 2d, 3d, 4d, 6d). Schemes of declaration of conformity for the technical means not included in the List, are selected by the manufacturer (person authorized by the manufacturer) or the importer.

At the discretion of the manufacturer (person authorized by the manufacturer) or the importer the technical means not included in the List, may undergo the procedure of confirmation of conformity in the form of certification in accordance with paragraph 5 of this article.

In the case of non-application of the standards listed in paragraph 1 of the article 6 of this technical regulation of the Customs Union, or in the case of their absence, technical means undergo the procedure of confirmation of conformity in the form of certification (schemes 1c, 3c, 4c), in accordance with paragraph 10 of this article.

3. Certification of mass-production technical equipment is carried out according to the scheme 1c. Technical equipment for the certification procedure is provided by the manufacturer (person authorized by the manufacturer).

Certification of a batch of technical equipment is carried out according to the scheme 3c, certification of a single product is carried out according to the scheme 4c. A batch of technical equipment (a single product) manufactured within the common customs territory of the Customs Union is provided by the manufacturer, a batch of technical equipment (a single product) imported into the common customs territory of the Customs Union is provided by the importer or the manufacturer (person authorized by the manufacturer).

4. Certification of technical equipment is carried out by a certification (evaluation (confirmation) of conformity) authority included in the Common Register of certification bodies and testing laboratories (centers) of the Customs Union. Certification tests are carried out by an accredited testing laboratory (center) included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union.

5. The procedure of technical equipment certification (schemes 1c, 3c, 4c) implies that:

5.1. manufacturer (person authorized by the manufacturer) or importer provides the certification (evaluation (confirmation) of conformity) authority with a set of documents on the technical equipment proving its compliance with the electromagnetic compatibility requirements of the technical regulation of the Customs Union, including:
  • technical specifications (if any);
  • operational documents;
  • a list of standards that set out the requirements related to the technical equipment from the List of standards mentioned in paragraph 1 of article 6 of this technical regulation of the Customs Union;
  • contract (supply contract) or shipping documentation (for a batch of technical equipment (a single product) (schemes 3c, 4c);
5.2. manufacturer shall take all the necessary measures to stabilize the production process and to ensure the compliance of produced technical equipment with the requirements of this technical regulation of the Customs Union;
5.3. certification (evaluation (confirmation) of conformity) body:
5.3.1. selects a specimen (specimens);
5.3.2. identifies the technical equipment through the procedure of confirmation of conformity of its characteristics to those specified in article 1 of this technical regulation of the Customs Union, with requirements set out in article 5 of this technical regulation of the Customs Union, and with documents listed in subparagraph 5.1. of paragraph 5 of this article;
5.3.3. performs tests of conformity of technical equipment specimen (specimens) to requirements of standards from the List of standards mentioned in paragraph 1 of article 6 of this technical regulation of the Customs Union, and analyses the test report (reports);
5.3.4. analyzes the state of production (scheme 1c).
If the manufacturer has the certified quality management system for the design and production of technical equipment, evaluates the ability of this system to ensure stable production of certified technical equipment that meet the requirements of this technical regulation of the Customs Union;
5.3.5. issues a certificate of conformity in unified form, approved by the Commission. Certificate of conformity for the mass-produced technical equipment is valid for no longer than 5 years, the period of validity of the certificate is unspecified for single batch of technical equipment (or a single product);
5.4. manufacturer (person authorized by the manufacturer) or importer:
5.4.1. labels the product with the Common mark of product circulation in the market of the Member States of the Customs Union;
5.4.2. after the procedure of confirmation of conformity, forms a set of documents for technical equipment that includes:
  • documents, mentioned in subparagraph 5 of this paragraph;
  • test report (reports);
  • production analysis results;
  • certificate of conformity.
5.5. Certification (evaluation (confirmation) of conformity) body conducts inspection control of the Certified technical equipment through testing of samples in an accredited testing laboratory (center) and (or) through production analysis (scheme 1c);

6. Declaring conformity of technical equipment (schemes 1d, 2d, 3d, 4d, 6d) is based on:

6.1. own evidence (schemes 1d, 2d):
  • testing of technical equipment (for a batch of technical equipment, single product) (scheme 2d);
  • testing of technical equipment and production control carried out by the manufacturer (for mass-produced technical equipment) (scheme 1d);
6.2. results of tests carried out by testing laboratory (center) included in the Common Register of certification bodies and testing laboratories (centers) of the Customs Union (schemes 3d, 4d, 6d):
  • testing of technical equipment (for a batch of technical equipment, single product) (scheme 2d);
  • testing of technical equipment and production control carried out by the manufacturer (for mass-produced technical equipment) (scheme 3d);
  • testing of technical equipment, certification of then quality management system for the design and production of technical equipment and production control carried out by the manufacturer (for mass-produced technical equipment) (scheme 6d).
6.3. Declaring conformity of mass-produced technical equipment is carried out by the manufacturer (person authorized by the manufacturer), according to schemes 1d, 3d, 6d.
Declaring conformity of a batch of technical equipment (a single product) is carried out by the manufacturer (person authorized by the manufacturer) or the importer, according to schemes 2d, 4d.

7. Declaring conformity of technical equipment according to schemes 1d, 2d, implies that:

7.1. manufacturer (person authorized by the manufacturer) or importer:
7.1.1. forms a set of documents proving the conformity of technical equipment to the requirements of this technical regulation of the Customs union that includes:
  • technical specifications (if any);
  • operational documents;
  • a list of standards that set out requirements related to the technical equipment from the List of standards mentioned in paragraph 1 of article 6 or this technical regulation of the Customs Union;
  • report (reports) on tests carried out in a testing laboratory (center) chosen by the manufacturer (person authorized by the manufacturer) or the importer;
  • certificate of conformity (if any);
  • manufacturer’s declaration of conformity (if any) (for a batch of technical equipment (a single product) (scheme 2d);
7.1.2. identifies the technical equipment through the procedure of confirmation of conformity of its characteristics with those specified in article 1 of this technical regulation of the Customs Union, with requirements set out in article 5 of this technical regulation of the Customs Union, and with documents listed in subparagraph 7.1.1 of paragraph 7.1 of this article;
7.2. manufacturer provides production control and takes all necessary measures to ensure the compliance of technical equipment with the requirements of this technical regulation of the Customs Union (scheme 1d).
Requirements for manufacturing processes and control, as well as for the results of their monitoring should be documented (in the form defined by the manufacturer);
7.3. manufacturer (person authorized by the manufacturer) or importer:
7.3.1. draws up a written declaration of technical equipment conformity to this technical regulation of the Customs Union in a unified form, approved by the Commission, and labels goods with the Common mark of product circulation in the market of the Member States of the Customs Union;
7.3.2. once the procedure of confirmation of conformity is finished, includes the declaration of conformity to a set of technical equipment documents listed in sub-paragraph 7.1.1 of this paragraph.

8. Declaring conformity of technical equipment according to schemes 3d, 4d, 6d implies that:

8.1. manufacturer (person authorized by the manufacturer) or importer:
8.1.1. forms a set of technical equipment documents that includes:
  • technical specifications (if any);
  • operational documents;
  • a list of standards that set out requirements related to the technical equipment from the List of standards mentioned in paragraph 1 of article 6 or this technical regulation of the Customs Union;
  • contract (supply contract) or shipping documentation (for a batch of technical equipment (a single product) (schemes 4d);
  • certificate of conformity for the quality management system for the design and production of technical equipment (scheme 6d);
8.1.2. identifies the technical equipment through the procedure of confirmation of conformity of its characteristics with those specified in article 1 of this technical regulation of the Customs Union, with requirements set out in article 5 of this technical regulation of the Customs Union, and with documents listed in subparagraph 8.1.1 of paragraph 8.1 of this article;
8.1.3. performs tests of technical equipment specimen (specimens) conformity to the requirements of standards from the List of standards mentioned in paragraph 1 of article 6 of this technical regulation of the Customs Union, and analyses the test report (reports);
8.2. manufacturer:
  • monitors the production process and takes all necessary measures to ensure the compliance of technical equipment with the requirements of this technical regulation of the Customs Union (scheme 3d, 6d). Requirements for manufacturing processes and control, as well as the monitoring results should be documented (in the form set by the manufacturer);
  • takes all the necessary measures to stabilize the production process and to ensure the compliance of produced technical equipment with the requirements of this technical regulation of the Customs Union (scheme 6d);
8.3. manufacturer (person authorized by the manufacturer) or importer:
  • 8.3.1. draws up a written declaration of technical equipment conformity to this technical regulation of the Customs Union in a unified form, approved by the Commission, and labels goods with the Common mark of product circulation in the market of the Member States of the Customs Union;
  • 8.3.2. once the procedure of confirmation of conformity is finished, forms a set of technical equipment documents that includes:
  • documents set out in subparagraph 8.1.1 of paragraph 8.1 of this article;
  • test report (reports);
  • declaration of conformity.

9. Declaration of conformity shall be registered in accordance with the legislation of the Customs Union. The declaration is valid from its registration date.

Mass-produced technical equipment declaration of conformity is valid for no longer than 5 years, the validity period is unspecified for the declaration of conformity on a batch of technical equipment (a single product).

10. During the process of technical equipment certification, in case of non-application of the standards listed in paragraph 1 of the article 6 of this technical regulation of the Customs Union, or in case of their absence (schemes 1c, 3c, 4c):

10.1 manufacturer (person authorized by the manufacturer) or importer provides certification (evaluation (confirmation) of conformity) authority with a set of documents on the technical equipment proving its compliance with the electromagnetic compatibility requirements of the technical regulation of the Customs Union including:
  • technical specifications (if any);
  • operational documents;
  • a description of adopted technical solutions, proving the conformity to the requirements for electromagnetic compatibility of this technical regulation of the Customs Union;
  • a contract (supply contract) or shipping documentation (for a batch of technical equipment (a single product) (schemes 3c, 4c);
10.2. manufacturer takes all necessary measures to stabilize the production process and to ensure the compliance of produced technical equipment with the requirements of this technical regulation of the Customs Union;
10.3. certification (evaluation (confirmation) of conformity) body:
10.3.1. selects a specimen (specimens);
10.3.2. identifies the technical equipment through the procedure of confirmation of its characteristics conformity to those specified in article 1 of this technical regulation of the Customs Union, with requirements set out in article 1 of this technical regulation of the Customs Union, the provisions of article 5 of this technical regulation of the Customs Union and with documents listed in subparagraph 10.1. of paragraph 10 of this article;
10.3.3. carries out the procedure of confirmation the conformity of technical equipment directly with the requirements for electromagnetic compatibility of this technical regulation of the Customs Union.
Within the procedure of confirmation the certification (evaluation (confirmation) of conformity) body:
  • sets out specific requirements for electromagnetic compatibility for the certified technical equipment, based on the requirements for electromagnetic compatibility of this technical regulation of the Customs Union and the conditions of electromagnetic environment in which this technical equipment is intended to operate;
  • analyses the technical solutions, adopted by the manufacturer and proving the conformity to the requirements for electromagnetic compatibility of this technical regulation of the Customs Union;
  • determines the standards from the List of standards, mentioned in paragraph 2 of article 6 of this technical regulation of the Customs Union that set the methods of measurements and testing or, in case of their absence, determines the methods of monitoring, measurements and testing for confirmation of conformity of technical equipment with specific requirements for electromagnetic compatibility;
  • performs technical equipment testing and analyses testing report (reports);
10.3.4. analyses the state of production (scheme 1c);
If the manufacturer has the certified quality management system for the design and production of technical equipment, evaluates the ability of this system to ensure stable production of certified technical equipment that meet the requirements of this technical regulation of the Customs Union;
10.3.5. issues a certificate of conformity in unified form approved by the Commission.
The mass-produced technical equipment conformity certificate is valid for no longer than 5 years, the period of validity is unspecified for a batch of technical equipment (a single product);
10.4. manufacturer (person authorized by the manufacturer) or importer:
10.4.1. labels the product with the Common mark of product circulation in the market of the Member States of the Customs Union;
10.4.2. once the procedure of confirmation of conformity is finished, forms a set of documents for technical equipment that includes:
  • documents, mentioned in subparagraph 10.1 of this paragraph;
  • test report (reports);
  • production analysis results;
  • certificate of conformity.
10.5. Certification (evaluation (confirmation) of conformity) body conducts inspection control of the Certified technical equipment through testing of samples in an accredited testing laboratory (center) and (or) through production analysis (scheme 1c);

11. During the confirmation procedure of fixed installations at the discretion of the manufacturer an expertise is carried out on operational documentation related to electromagnetic, as well as computational and experimental methods are applied, their documented results shall be included in the set of technical equipment documents.

12. Set of technical equipment documents shall be stored within the territory of Member-States of the Customs Union:

  • for technical equipment: documents are stored by the manufacturer (person authorized by the manufacturer) for at least 10 years since this technical equipment discontinuance (termination of its production);
  • for a batch of technical equipment: documents are stored by the importer or by the person authorized by the manufacturer for at least 10 years since the date of selling of the last product from the batch.

Article 8. Labelling by the common mark of products circulation in the market of the Customs union member-states

1. Technical equipment conforming to the electromagnetic compatibility requirements of this technical regulation of the Customs union and having undergone the procedure of conformity confirmation in accordance with article 7 of this technical regulation of the Customs union should be labelled by the common mark of products circulation in the market of the Customs union member-states.

2. Products should be labelled by the common mark of products circulation in the market of the Customs union member-states before the start of its sales in the market.

3. Each product should be labelled by the common mark of products circulation in the market of the Customs union member-states in a way that will be clear and legible during the whole exploitation period of technical equipment, the common mark should also be provided in attached exploitation documents.

4. If it is impossible to label the technical equipment itself by the common mark of products circulation in the market of the Customs union member-states, the common mark should be provided on the package of this technical equipment and in the attached exploitation documents.

5. Technical equipment should be labelled by the common mark of products circulation in the market of the Customs union member-states if it conforms to the requirements of all technical regulations of the Customs union to which it is subject, and which imply the procedure of labelling.

Article 9. Protective clause

Customs union member-states are obliged to take all necessary measures to restrict and prohibit the circulation of technical equipment within the common territory of the Customs union, as well as to withdraw technical equipment from the market that do not conform to the electromagnetic compatibility requirements of this technical regulation of the Customs union.

Annex 1. Types of technical equipment passive to electromagnetic compatibility that are not subject to the technical regulation of the Customs Union "Electromagnetic compatibility of technical equipment"

  1. Wires, cords, cables and cable assemblies.
  2. Technical equipment that implies only resistance load and no automatic switch devices, such as household electronic heater without any thermostat or ventilator.
  3. Electric batteries and accumulators and lightning equipment fed by them and containing no active electronic circuits.
  4. Headphones and loud speakers without amplification.
  5. Protection equipment that creates short transitional electromagnetic interference (far less than 1 second) as a result of short circuit or abnormal situation in electric circuit that does not contain fuses (emergency shutdown devices) with active electronic parts.
  6. High voltage electrical equipment in which potential electromagnetic interference sources are caused only by local insulation defects (high voltage magnetos or high voltage transformers, for example) if such equipment does not contain any active electronic parts.
  7. Capacitors (capacitors for power-factor correction, for example).
  8. Induction motors.
  9. Quartz watch (without any additional functions, such as radio reception, for example).
  10. Filament lamps.
  11. Plugs, sockets, fine-wire fuses, switches and automatic switches without any active electronic circuits.
  12. Passive antennas for radio and TV signals reception.


Annex 2. Types of electromagnetic interference created by technical equipment and (or) affecting technical equipment which is subject to the Technical Regulation of the Customs Union "Electromagnetic compatibility of technical equipment"

1. Low frequency conducted interference:

  • established power voltage deviations;
  • power voltage harmonicity deviations;
